  • Professional advisors. Our attorneys, accountants, insurers, and similar advisors, each bound by a duty of confidentiality.

  • Regulators and law enforcement. Where required by applicable law, court order, subpoena, or our licensing obligations, or where we believe in good faith that disclosure is necessary to protect our rights, safety, or property, or that of others.

  • Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our assets, in which case personal information may be transferred as a business asset, subject to this Policy.

  • With your consent, or at your direction.

We do not sell, rent, or trade personal information to third parties for their own marketing purposes.

8. Third-Party Links and Platforms

The Site contains links to third-party websites and platforms, including dispensary locator and retail menu services such as Leafly, Weedmaps, and Dutchie. When you follow one of these links, you leave the Site and any information you provide is governed by that third party’s own privacy policy and terms. We do not control and are not responsible for the privacy practices of those services. We encourage you to review their policies before providing any information.

9. How Long We Keep Information

  • Records we are required to keep under Oklahoma law or OMMA rules: retained for the period those rules require.

10. How We Protect Information

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect, including encryption of data in transit (HTTPS/TLS), access controls limiting who on our team can view form submissions, and multi-factor authentication on administrative accounts.

No method of transmission over the Internet or method of electronic storage is completely secure. While we work to protect your information, we cannot guarantee its absolute security.

11. Your Choices and Rights

11.1 Marketing communications

Every marketing email we send includes an unsubscribe link. You may also email us at privacy@redbirdmmj.com to be removed. We will process opt-out requests promptly. We may still send you non-marketing messages, such as a direct reply to an inquiry you submitted.

Depending on where you live, you may have the right to:

  • Confirm whether we process personal information about you, and access that information;

  • Correct inaccurate personal information;

  • Request deletion of personal information we hold about you;

  • Obtain a portable copy of personal information you provided to us;

  • Opt out of the sale of personal information, targeted advertising, and profiling that produces legal or similarly significant effects. As described in Section 5, we do not currently engage in these activities;

  • Appeal a decision if we decline your request.

These rights arise under state privacy laws including the California Consumer Privacy Act and comparable laws in Colorado, Connecticut, Texas, Virginia, and other states. The Oklahoma Consumer Data Privacy Act takes effect January 1, 2027.

11.3 How to make a request

Submit requests to privacy@redbirdmmj.com or by mail at the address in Section 15. We will respond within 45 days of receipt, and may extend that period by an additional 45 days where reasonably necessary, in which case we will notify you. If we decline your request, you may appeal by replying to our response; we will respond to an appeal within 60 days.

To protect your information, we will take reasonable steps to verify your identity before acting on a request. We may decline requests where we cannot verify the requester, or where an exception under applicable law applies. You will not be charged or treated differently for exercising these rights.

11.4 Authorized agents

You may designate an authorized agent to make a request on your behalf. We may require written proof of the agent’s authority and verification of your identity.

12. Do Not Track and Global Privacy Control

Some browsers transmit “Do Not Track” signals. There is no common industry standard for how to interpret them, and the Site does not currently respond to Do Not Track signals. The Site does recognize Global Privacy Control (GPC) signals. If your browser sends a GPC signal, the Site automatically treats it as a request to reject all non-essential cookies and similar technologies, without you needing to use the cookie banner.

13. Age Restrictions

The Site is intended for adults and is not directed to children. Visitors are asked to confirm that they are 21 years of age or older before entering the Site. We do not knowingly collect personal information from anyone under the age of 21. If you believe that a person under the age of 21 has provided personal information to us through the Site, please contact us at privacy@redbirdmmj.com and we will delete it.

Oklahoma medical marijuana products are available only to individuals holding a valid patient or caregiver license issued by OMMA, and only through licensed dispensaries.

We may update this Privacy Policy from time to time. When we do, we will post the revised version on the Site and update the “Last Updated” date above. If we make material changes to how we handle personal information, we will provide additional notice, such as a notice on the Site or an email to subscribers.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the revised version on the Site and update the “Last Updated” date above. If we make material changes to how we handle personal information, we will provide additional notice, such as a notice on the Site or an email to subscribers. Your continued use of the Site after the revised Policy takes effect constitutes acceptance of the changes.
